INFORMATION ABOUT THE PROTECTION OF PERSONAL DATA
The data protection regulation requires those responsible for the processing of files that contain personal data to provide the following additional information when collecting personal data. The tour registration form contains basic information on the collection and processing of the data that is provided in it, and additional information is included in this section.
RESPONSIBILITY
The Rafa Nadal Foundation is responsible for the www.rafanadaltour.com website.
The Rafa Nadal Foundation was established by a notarized deed executed before the notary of Palma de Mallorca Mr. Miguel Mulet Ferragut on November 20th, 2007, and is listed in the register of foundations of the Spanish Ministry of Education, Culture and Sport under number 1539.

PRINCIPLES
The Rafa Nadal Foundation, as well as any staff member who has access to personal data, applies the principles listed below. The personal data shall be:
- processed lawfully, fairly and in a transparent manner
- collected for specified, explicit and legitimate purposes, and not further processed in a way that is incompatible with such purposes
- adequate, relevant and limited to what is necessary, concerning the purposes for which they are processed
- accurate and, when necessary, updated, taking all reasonable measures to delete or correct those that are inaccurate regarding the purposes for which they are processed
- kept for no longer than is necessary for the purposes of the processing
- processed with integrity and confidentiality, in such a way that adequate security is ensured.
TYPE OF DATA PROCESSED
The data we process mainly consists of basic information for the identification of the minor who intends to participate in the tournament and for the identification of his/her parents or legal representative (name, surname, ID number and e-mail). We also collect data related to the tennis club or sports federation to which the player is associated.
The personal data provided must be truthful, accurate and complete and kept up to date. The registration of information by using the form is mandatory, at least for those data which are marked as such, and will imply that the user has been informed and has agreed to the content of this privacy policy and to the tour’s rules and code of conduct. Failure to provide these or providing incorrect information will prevent the Rafa Nadal Foundation from properly managing the applications made.
Information about the tour values: during the course of the tour, some activities are carried out with the purpose of fostering essential values for the players’ personal and athletic development, such as sportsmanship, self-improvement, fellowship, effort and commitment. Two actions are taken: players voluntarily fill out questionnaires about their performance in a match or in the tournament; and they are rated for a position in the ranking of values, which may provide a place in the final tournament, based on the following aspects:
- Attitude: the player’s behavior and attitude throughout the tournament will be evaluated, both on the court and during the off-court values activities.
- Court: performance and behavior during the matches.
- Values activities: player’s attitude when carrying out the off-court activities.
- Values activities: regarding the activities created to train the different values and attitudes, the following elements are taken into account:
- Participation:a proactive attitude adds points.
- Results: they are evaluated according to different factors (number of participants, characteristics of the activity, etc.).
- Record: there is the possibility to register personal best or collective records in some activities.
- Behavior: inappropriate behavior during the tournament is penalized, among others:
- Abuse: inappropriate use of the racquet and verbal abuse.
- No handshake: refusal to shake hands with the opponent at the end of the match.
- Not to apologize: lack of apology when the occasion requires it.
- Sportsmanship: unsportsmanlike behavior during the tournament in the locker rooms, hotel, restaurant, court.
The implementation of the values training is indeed an essential element of the tour and one of the factors that have contributed to its unique character.

We capture images and video of the players during the tournaments with the sole aim of advertising the tour on this site and the Foundation’s website and social networks, or in Rafa Nadal’s or sponsors’ website or social networks, and for which we request the corresponding authorizations following the current legislation.
PURPOSE
The purposes of the processing of personal data are: management of the player’s registration for the Rafa Nadal Tour by Santander and the corresponding authorizations for the player’s participation in it; and the elaboration of the ranking of values to foster these values in the players’ personal and sport life and to determine the eighth position in the final tournament.
In addition, we use your personal data to send, to the e-mail address provided, regular information on topics related to the Rafa Nadal Tour by Santander, our newsletter and other information about the Rafa Nadal Foundation’s activities and projects that may be of interest to you.
DATA RETENTION
The Rafa Nadal Foundation will keep the data for the period of time that has been legally established for the fulfillment of its obligations, or for the necessary time to fulfill the purpose for which they were collected and to establish the potential liability that may result from such purpose and processing. The data regarding the ranking of values will be preserved for one year after the end of the tour. As for the reception of the newsletter and electronic communications, the information will be kept until the user requests otherwise.
In other to establish appropriate data retention, we also take into consideration the following factors: amount, type and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of the personal data, the purposes for which we process these data, and any applicable legal requirements.
LEGITIMACY
The legal basis for the data processing is the participation in the tournament, by agreeing to the registration contract for the Rafa Nadal Tour by Santander. The Foundation sends information about the Rafa Nadal Tour by Santander and the Rafa Nadal Foundation based on the previous consent, which is requested by the entity, and in no case, the annulation of this consent will affect the participation of the child in the tournament.
We will not use your personal information to make automated decisions that may affect or create profiles other than those described above.
RECIPIENTS
The participants’ and their representatives’ personal information may be submitted or communicated to the following recipients:
- Data processing companies: suppliers that provide services to the Rafa Nadal Foundation, such as the administration of promotional campaigns, content managers, organization and evaluation of the tour activities and values. Service providers are authorized to use the data insofar as it is necessary to perform and provide the services for which they were contracted and subject to the terms agreed in the concluded contracts for the data processing and in this privacy policy.
- Hosting clubs for each of the tournaments: Real Club de Tenis Barcelona (Barcelona), Asociación Recreativa Río Grande (Sevilla), CE Valldoreix (Barcelona), C. A. Montemar (Alicante), Club Español de Tenis (Valencia), Club Internacional (Madrid) and Academia de Tenis Rafa Nadal (Mallorca). The data provided to them will be the name, surname and license number of the registered participants so that the draws can be created.
- The tennis federation to which the participant is associated in order to register their performance for the rankings.

- Public administrations and institutions when so required by the tax, labor or any other applicable regulations.
RIGHTS
Individuals who provide their personal data may exercise the rights indicated in the personal data protection regulations and, particularly, their rights of access, opposition, rectification, deletion and withdrawal of the given consent:
- Right of access: you have the right to gain access to your personal information (given that we are processing it).
- Right of opposition: you have the right to object to the processing of your data.
- Right of rectification: you have the right to correct or update your personal information when it is inaccurate or incomplete.
- Right of deletion: you can request the deletion or removal of your personal information when there is no significant reason for us to continue to use it.
- Right of withdrawal of consent: you can withdraw your consent at any time. The withdrawal of consent will not affect the legality of the processing based on the consent given before its withdrawal.
In certain circumstances, data subjects may also request the limitation of the processing of their data, in which case the organization will only keep them for the exercise or defense of claims. The limitation of data processing can only be requested when:
- The data subject has exercised the rights of opposition or rectification and the Foundation is in the process of deciding whether to grant the request.
- The processing is illicit, which would result in the deletion or removal of the data, but the data subject objects.
- The data is no longer necessary but the data subject requests its limitation because he/she needs it for the exercise or defense of claims.
In addition, data subjects have the right to the portability of their data, that is, to receive, while using the website, the information provided in a structured format that allows him/her to store it or transfer it to another data processor.
